Terms of Service
These terms govern your use of this website and, together with the proposal you accept, the consultancy services we provide. The short version: scope, deliverables, fees, and timing are agreed in writing before work starts; you own the bespoke work once invoices are paid; both sides keep information confidential; and the agreement is governed by the laws of Ireland.
How an engagement works, in writing.

About these terms
These terms apply to beneathanalytics.io and to the services Beneath Analytics provides to clients. Using the website means you accept the parts that concern the website. Engaging us means you also accept the service terms below, which sit alongside your proposal, statement of work, or order form. If a signed proposal says something different from this page, the proposal wins for that engagement.
Who we are
Beneath Analytics is an analytics, data, and AI consultancy based in Carrickmacross, Co. Monaghan, Ireland. You can reach us at contact@beneathanalytics.io. Where these terms say “we”, “us”, or “our”, they mean Beneath Analytics; “you” means the person using the site or the organisation engaging our services.
This website
The content on this site is general information about what we do. It is not legal, financial, or regulated advice, and it should not be relied on as a substitute for advice about your own situation. We keep it current but do not promise that every page is complete or free of errors.
The site links to third-party properties, including our product sites and LinkedIn. Those sites are operated by others, their terms apply to them, and we are not responsible for their content or availability.
Services and scoping
We provide consultancy and delivery services across analytics, data, AI, automation, and software. Every engagement is defined in a proposal or statement of work that sets out the scope, the deliverables, the timeline, the people involved, and the fees. Anything not described there is out of scope and is handled as a change request before we start it.
Estimates depend on the information and access you give us. If assumptions made during scoping turn out to be wrong, we will tell you promptly and agree the effect on scope, timeline, and fees before continuing.
Fees, invoices, and taxes
Fees, currency, payment schedule, and any taxes that apply are stated in your proposal or on the invoice. Unless the proposal says otherwise, invoices are payable within the period shown on the invoice.
If an invoice is overdue, we may pause work after giving you written notice, and the affected timelines move by the length of the pause. Fees exclude any taxes that you are responsible for under applicable law.
Your responsibilities
Engagements run on your input: timely access to systems, data, and people; data you have the right to give us; and a decision-maker who can approve work. Delays on your side extend timelines accordingly.
You are responsible for reviewing deliverables and testing them in your own environment before relying on them in production, and for the decisions you make using the outputs we build.
Intellectual property
Once all invoices for an engagement are paid, you own the bespoke deliverables created specifically for you under it: code written for your project, dashboards, pipelines, documentation, and the design of any custom components.
We keep ownership of what we bring to the table: pre-existing methods, frameworks, libraries, know-how, and reusable components, together with the general ideas and experience gained on the job. Where a deliverable embeds something under an open-source or third-party licence, that licence applies to that component.
We may describe the engagement in our portfolio and case studies on an anonymised basis unless you agree otherwise in writing.
Confidentiality
Each party keeps the other's confidential information secret, uses it only for the engagement, and does not disclose it except to people who need it and are bound by similar obligations. Confidential information does not include information that is public through no fault of ours, already lawfully known to you, or independently developed.
This obligation continues for two years after the engagement ends, and indefinitely for trade secrets.
Data protection
Both parties comply with the GDPR and the Irish Data Protection Act 2018 in relation to personal data handled during an engagement. Where we process personal data on your behalf as a processor, a data processing agreement applies and we act only on your documented instructions.
Our own handling of personal data collected through this website is described in our Privacy Policy.
Third-party platforms
Much of this work runs on platforms we do not control: Google Analytics, BigQuery, Google Ads, Meta, cloud providers, and others. Their terms, pricing, and roadmaps apply to your accounts, and changes on their side may affect the work. We are not liable for their outages, price changes, or policy changes, though we will flag material impacts where we become aware of them.
Warranties
We will perform the services with reasonable skill and care, using people competent to do the work. Other than that, the website and any general content are provided as they are, and we give no warranty that they will be uninterrupted or error-free.
We do not guarantee commercial outcomes (revenue, rankings, conversion rates, or model accuracy in production) because those depend on factors outside our control, including your data, your market, and decisions made after handover.
Liability
To the extent permitted by law, our total liability arising from an engagement is limited to the fees paid to us for that engagement in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential losses, or for lost profits, lost savings, or loss of data, except where such a limitation is not permitted.
Nothing in these terms limits or excludes liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be excluded under Irish law.
Ending an engagement
Either party may end an engagement as set out in the proposal, or by giving written notice if none is stated. On termination you pay for work carried out up to the end date, and we hand over the work in progress and any documentation that exists at that point.
Terms that by their nature should continue (intellectual property, confidentiality, liability, and governing law) survive termination.
Governing law
These terms, and any dispute arising out of them, are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, without prejudice to any mandatory consumer protections that apply in your country of residence.
Changes to these terms
We may update these terms from time to time. The date at the top of the page shows when they last changed, and continued use of the website after a change means you accept it. For an engagement already under way, changes apply only if we agree them with you in writing.
